Applicant:
- Natural persons or legal entities. Foreigners enjoy same rights as nationals; must elect a patent attorney in Kazakhstan.

Requirements (to be sent to resident agent for filing an application):

- Power of Attorney (no legalization);
- Specification, claims and abstract (may be filed in Kazak or Russian language, or any other language, whereby the certified Kazak or Russian translation should be filed within two months from the filing date);
- Drawing, 3 sets;
- Priority certificate, if any (to be filed within six months from the filing date).

Examination Procedure:
- A substantive examination is carried out

Granting:
- Beginning, duration and extension of protection: ten years from the filing date; renewable for further ten-year periods

Annuities:
- Payments of fees is foreseen (grace period of 6 months)

Amendment of issued patent:
- Additional materials modifying the claimed sign in a substantive way are not acceptable.

Licenses:
- Must be registered in the Patent Office; may be exclusive or non-exclusive and only for a part of goods and services.

Assignment:
- To be registered; not recognized if it leads to confusion in respect to goods and place of origin of its manufacturer.

Trademarks

Examination:

Preliminary:
- Within two months from the filing date, regarding formal requirements;
Complete:
- Within twelve months from the filing date, regarding identical or similar previous registration for similar goods and registrability.on absolute and relative grounds

Opposition:
- Provided for.

Granting:
- Beginning, duration and extension of protection: ten years from the filing date; renewable for further ten-year periods;

Last term of renewal:
- Up to 4 months after the normal period has elapsed

Licenses:
- Must be registered in the Patent Office; may be exclusive or non-exclusive and only for a part of goods and services.

Assignment:
- To be registered; not recognized if it leads to confusion in respect to goods and place of origin of its manufacturer.
