Protection of Trademarks in Netherlands Antilles
Since the Netherlands Antilles was dissolved last year (forming two new countries, Curaçao and Sint Maarten), the previous trademark registrations are no longer valid.
Regarding Curaçao and Sint Maarten, on October 10, 2010, former Netherlands Antilles registrations were converted into two separate registrations which will be due for renewal on their original Netherlands Antilles expiry date.
However, regarding the other islands formerly comprising Netherlands Antilles, the BES Islands (Bonaire, Sint Eustatius and Saba), each former Netherlands Antilles trademark registration must be confirmed by filing a maintenance declaration, or these wont have any protection in the BES Islands.
To ensure the continued protection of your trademark rights in all the jurisdictions previously covered by a Netherlands Antilles registration, please provide us with your instructions as soon as possible.
